29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a) AGH Signage Clairton Road, Jefferson Hills, PA:  Observed on or about October 21, 2015, an employee working at the bottom of a trench that was approximately 6.6 feet deep with near vertical sidewalls was not protected from cave-ins.  The employee was exposed to an engulfment hazard while using a hydraulic hammer to remove rock and debris from the sides and bottom of the trench.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  a) AGH Signage Clairton Road, Jefferson Hills, PA:  Observed on or about October 21, 2015, The competent person did not remove an employee working at the bottom of a trench that was approximately 6.6 feet deep with near vertical sidewalls that was not protected from cave-ins.  The employee was exposed to an engulfment hazard while using a hydraulic hammer to remove rock and debris from the sides and bottom of the trench.

29 CFR 1926.701(b):  All protruding reinforcing steel, onto and into which employees could fall, were not guarded to eliminate the hazard of impalement:    a) AGH Signage Clairton Road, Jefferson Hills, PA:  Observed on or about October 21, 2015,  An employee working at the edge of a trench that was approximately 6.6 feet deep with near vertical sidewalls that was not protected from impalement hazards from exposed rebar ends. The rebar ends were not covered by a guard.

The employee was not wearing a protective helmet while using a hydraulic hammer to remove rock and debris from the sides and bottom of the trench.
