29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  a. On or before October 21, 2015, the employer did not establish an energy control program, thereby exposing employees to caught-in, struck-by, or other hazards.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.  a. On or before October 21, 2015, in the grind room where employees use the bowl chopper to mix and grind meats, the bowl chopper was not guarded, resulting in the amputation of an employee's fingers.

29 CFR 1910.303(b)(1)(viii): Other factors that contribute to the practical safeguarding of persons using or likely to come in contact with the equipment.    a. On the bowl chopper where the discharge motor was replaced and wires spliced, the conduit was removed exposing the splice, thereby exposing the employees to an electrical contact hazard.      b. On the left side of the bowl chopper where the electrical wiring went into the side of the machine, the metal clad electrical conduit was broken/rusted apart, exposing the wiring to the sharp edges of the conduit and wet conditions, thereby exposing the employees to an electrical contact hazard.

29 CFR 1910.303(c)(3)(i): Conductors shall be spliced or joined with splicing devices identified for the use or by brazing, welding, or soldering with a fusible metal or alloy. Soldered splices shall first be spliced or joined to be mechanically and electrically secure without solder and then soldered. All splices and joints and the free ends of conductors shall be covered with an insulation equivalent to that of the conductors or with an insulating device identified for the purpose.    a. On the bowl chopper where the discharge motor was replaced and wires spliced, the wires were spliced and taped with electrical tape which does not meet the insulation equivalent of the conductors, thereby exposing the employees to an electrical contact hazard.

29 CFR 1910.305(e)(1): Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures. Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in damp or wet locations shall be installed so as to prevent moisture or water from entering and accumulating within the enclosures and shall be mounted so there is at least 6.35-mm (0.25-in.) airspace between the enclosure and the wall or other supporting surface. However, nonmetallic enclosures may be installed without the airspace on a concrete, masonry, tile, or similar surface. The enclosures shall be weatherproof in wet locations.  a. On the wall behind the bowl chopper, the 240 volt 3-phase electrical box enclosure was open on the bottom where the conductors entered, exposing the employees to an electrical contact hazard.
