29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. (a) Jobsite is located at 2 Hook Road, Bayonne, NJ 07002. Operators were exposed to an opening 15 inches wide where the guardrails had been removed on the control deck that exposed them to a fall of approximately seven feet to a concrete floor. Violation was observed on or about 10/15/2015. (b) Jobsite is located at 2 Hook Road, Bayonne, NJ 07002. Operators have had to climb over the laner to straighten bottles on the main conveyor at the feed point to the laner. The step over the laner puts employees at a working height of 37 inches above the control deck where guardrails are only 40 inches high exposing employees to a fall of approximately seven feet to a concrete floor. Violation was observed on or about 10/15/2015.

29 CFR 1910.23(e)(1): Standard railing(s) did not consist of top rail, intermediate rail and/or posts and/or did not have a vertical height of 42 inches (106.7 cm) nominal from upper surface of top rail to floor, platform runway, or ramp level. (a) Worksite is located at 2 Hook Road, Bayonne, NJ 07002. Operators were exposed to an incomplete guardrail system that was missing its intermediate rail and had a broken top rail that was improperly secured with tape to hold it in place. This guardrail was located at the top of the access ladder to the control deck. Violation was observed on or about 10/15/2015.
