29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) At the site, on October 23, 2015, the employer did not ensure that a personal fall arrest system, or other means of fall protection, was used by employees who were working from the top plates of the second floor installing the floor joists of the third floor, that measured nine feet from the second floor, of a three story, single family, residential townhouse, exposing employees to fall hazards.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a) At the site, on October 23, 2015, the employer did not ensure a stairway that measured thirteen feet in height, used by employees to access the second floor of the single family residential townhouse that was being constructed, was equipped with a handrail system, exposing employees to a potential fall hazard of up to thirteen feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) At the job site, on October 23, 2015, the employer did not ensure a ladder used by employees to access the top plates of the second story while placing the floor joists of the third floor, extended at least three feet above the access point, exposing employees to a fall hazard of up to nine feet.
