OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about October 21, 2015, at the job site an employee was observed climbing and standing on the guardrails of a scissor lift, approximately 10 feet high. This exposed the employee to the hazard of falling.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: On or about October 21, 2015, and at times prior thereto, employees were working from a steel personnel cage mounted on a powered industrial truck and raised to a height approximately 10 feet high. The employer did not have the powered industrial truck manufacturer's prior written approval to use the cage on the truck exposing the employees to the hazard of falls.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about October 21, 2015, at the job site forklift truck operator was operating a forklift truck without prior training or evaluation by a qualified person. Employees were exposed to struck-by hazards caused by inexperience operators.
