29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. Employees were engaged in commercial construction activities digging a trench to install 800.0 feet of sanitary sewer, 6.0 inch, SDR 35, piping for an addition to an existing structure. Workers were exposed to potential cave-in hazards in that a proper daily inspection of the job-site was not conducted.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (i): Excavations are made entirely in stable rock; or (ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. Employees were engaged in commercial construction activities digging a trench to install 800.0 feet of sanitary sewer, 6.0 inch, SDR 35, piping for a new addition to an existing structure. Workers were exposed to potential cave-in and struck-by hazards in that protection was not provided for the 3.6 foot area above the trench box.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61 m) below the bottom of the members of a support system shall be permitted, but only if the system is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the support system. Employees were engaged in commercial construction activities digging a trench to install 800.0 feet of sanitary sewer, 6.0 inch, SDR 35, piping for a new addition to an existing structure. Workers were exposed to potential cave-in and struck-by hazards in that there was 4.4 feet of unprotected soil beneath the trench box.
