OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards due to the Moffett Mounty powered industrial truck being able to tip over easily while being operated on unleveled ground:     a) On or about 10/12/2015 -  Lumber yard, a worker operating a Moffett Mounty, model #5500, serial #C24261 on unleveled ground, while moving 4-inch by 6-inch by 20-foot long lumber, tipped the Moffett causing the load to slide off the forks  and land on another worker who was placing cribbing down for the load.
