OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards due to the Moffett Mounty powered industrial truck being able to tip over easily while being operated on unleveled ground: a) On or about 10/12/2015 - Lumber yard, a worker operating a Moffett Mounty, model #5500, serial #C24261 on unleveled ground, while moving 4-inch by 6-inch by 20-foot long lumber, tipped the Moffett causing the load to slide off the forks and land on another worker who was placing cribbing down for the load.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) On or about 10/23/2015 - Lumber yard, a lockout/tagout program was not established when workers engaged in maintenance and servicing of equipment such as 13,500 pound Caterpillar Model #DP40, Serial #3CM12832, diesel powered industrial truck, and the Moffett Monty powered industrial truck with electrical, hydraulic, and gravity sources of energy.
