OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to unintended movement of vehicles and equipment while parked on a grade: (a) Turner Tract: On or about October 23, 2015, and times prior, an employee was performing the coupling operation of hooking a 2009 Kenworth W900L semi-truck to a 1998 Talbert detachable gooseneck lowboy trailer while parked on a 22% grade. Wheel chocks were not used to ensure no movement while performing the work between the truck and the trailer, approximately 32 inches from the tires of the semi-truck.

29 CFR 1910.266(i)(3)(ii): Training content did not consist of safe use, operation and maintenance of tools, machines and vehicles the employee used or operated, including emphasis on understanding and following the manufacturer's operating and maintenance instructions, warnings and precautions. (a) Turner Tract: On or about October 23, 2015, and times prior, employees who are required to operate trucks and trailers, such as, but not limited to a 2009 Kenworth W900L semi-truck and a 1998 Talbert detachable gooseneck lowboy trailer were not trained on the manufacturer requirements to chock tires, load and unload on level ground/surface, and to apply parking brakes, all of which ensured that there was no movement when working on and/or around the equipment.
