29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about October 26, 2015, and at times prior thereto, employees were exposed to the hazards of being struck by/crushed by the deck of the lawn mowing equipment in that an Energy Control Program (Lockout/Tagout) had not been developed and utilized for such equipment as, but not limited to, the Jacobsen HR 9016 Turbo Rotary Mower.

29 CFR 1910.147(c)(5)(i): Locks, tags, chains, wedges, key blocks, adapter pins, self-locking fasteners, or other hardware were not provided by the employer for isolating, securing or blocking of machines or equipment from energy sources: On or about October 26, 2015, and at times prior thereto, the locking pin on the left side mower deck was missing on the Jacobsen Rotary Mower, exposing employee to the hazard of being crushed/struck by the mower deck in the event the hydraulic system should fail.
