OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and impalement hazards. On or about 15 October 2015, and at times prior thereto, employees working in the yard to "push" bulls into holding pens were exposed to struck by and impalement hazards. A yard hand was herding a bull into a holding pen when the bull changed direction in the alley and charged the worker, who attempted to climb the fence. The worker was not able to clear the fence and was gored by the bull's horn. The employer did not provide an effective training program for each employee who might be exposed to struck by and impalement hazards while working with bulls.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov. On 15 October 2015, at approximately 9:30 AM, an injury occurred at 1131 North Bell Street, San Angelo TX in which an employee was gored by a bull resulting in the employee being in-patient hospitalized. The hospitalization of the employee was not reported to the Austin Area Office of the Occupational Safety and Health Administration within twenty-four (24) hours.
