OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while operating the arms of the Squeezer machine with a pendant controls. On or about 22 October 2015, and at times prior thereto, operators were required to utilize the pendant control units for a Squeezer machine during the welding process for steel girders. The pendant controls for the machine were not adequately labeled with the function of each control and the controls were not protected to prevent accidental contact, exposing the employees to the hazard of being caught between the equipment and the material.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, was not guarded. The guarding device was not in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, was not so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about 22 October 2015, and at times prior thereto, operators of the Squeezer machine are required to adjust the arms on the machine while holding a metal tube used to help level the web of a girder, exposing employees to the hazard of being caught between the metal tube and the lip of the arm.
