OSH Act of 1970 Section (5)(a)(1)  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to fall and crushing hazards.      The employer is failing to protect employees from fall and crushing hazards while using personnel platforms elevated by all-terrain forklifts.  Employees are being elevated using a JLG G9-43A All-Terrain Forklift and a homemade platform.  The platform has an overall length of 16 feet whereas the axel width of the forklift is 8 feet.  In accordance with ANSI B56.6  2002, the platform dimensions are not to exceed the axel base by more than 10 inches and in this case, the platform extended 32 past the allowable limits on each side of the forklift.  This creates an issue of instability for the forklift when the platform is elevated which could cause the lift to tip or become unsteady enough to cause an employee to fall.

29 CFR 1926.451(a)(6):   Scaffolds were not designed by a qualified person:    Worksite located at 7390 West Middle Road, Raymond, NE, 68428:  The employer is failing to protect employees from fall and crushing hazards while using personnel platforms elevated by all-terrain forklifts.  Employees are being elevated using a JLG G9-43A All-Terrain Forklift with a platform which extends past the axel base by more than 10 inches.       Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.

29 CFR 1910.178(l)(1)(ii)  This provision is applicable to construction employment by 29 CFR 1926.602(d).      29 CFR 1910.178(l)(1)(ii):  The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck:     Worksite located at 7390 West Middle Road, Raymond, NE: The employer failed to ensure that the employees operating a JLG allterrain powered industrial truck to elevate a personnel platform and move materials in and around the construction site had training on the hazards associated with operating all-terrain powered industrial trucks. 29 CFR 1926.451(g)(4)(i):     Guardrail systems were not installed along all open sides and ends of platforms.      Worksite located at 7390 West Middle Road, Raymond, NE, 68428:  The employer failed to ensure a complete guardrail system was installed on a platform supported by a forklift prior to allowing employees to work.  In this case employees were exposed to a fall of approximately 12 feet to the ground level below while utilizing the platform to access the roof.        Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.

29 CFR 1926.760(a)(1):   Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    Worksite located at 7390 West Middle Road, Raymond, NE, 68428: Employees are replacing metal roofing (decking) on a system engineered building are exposed to a fall hazard at heights greater than 15 feet without any form of fall protection.  On October 24, 2015, an employee fell over 21 feet sustaining fatal injuries.        Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citations.
