General-duty citation text
29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level: (a) On or about October 21, 2015, at a job site located at 1914 Main Street in Kansas City, MO, employees were exposed to the hazard of falling more than 10 feet to a lower level while working from a scaffold. The scaffold had been placed on the floor inside the building directly adjacent to a 3rd story wall opening. Although a normally configured guardrail system had been placed across the wall opening, the scaffold platform from which the employees were working elevated them above the top rail of the guardrail system rendering it ineffective and exposing them to falling out of the building to the ground from a height of approximately 4 feet above the 3rd floor. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
