29 CFR 1910.23(e)(3)(iv): The anchoring of posts and framing of members for railings of all types shall be of such construction that the completed structure shall be capable of withstanding a load of at least 200 pounds applied in any direction at any point on the top rail. In building five, staircase with 11 risers leading up to storage room above break room was inadequate in that the staircase railing was loose caused by poorly secured anchoring of posts and no there by exposing employees to a fall hazard.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: a. Hyster Forklift, model # H800XL, S/N F005D04941M had a locally manufactured pintle hook attachment affixed to the tips of fork tines. Forklift was not marked to identify approximate weight of the truck and attachment combination. Attachment tips of fork tines.was used to move a 41 foot Tierra recreational boat. b. Toyota Forklift, model # 5FCCU20, S/N 70991 had a non-factory installed pintle hook attachment affixed to the tips of fork tines. Forklift was not marked to identify approximate weight of the truck and attachment combination. Attachment was used to move 23 foot Four Winn's recreational boat.
