29 CFR 1926.602(b)(3): The safety requirements, ratios, or limitations applicable to machines or attachment usage covered in Power Crane and Shovel Associations Standards No. 1 and No. 2 of 1968, and No. 3 of 1969, where not complied with: (a) Sterling Management LLC at the Saddlehorn Pipeline Project, WCR 59 , Keenesburg, CO 80643: On and before October 29, 2015, the exposing employer did not ensure that the ground conditions were adequate to support a John Deere 350 Track Hoe to drag a 7 joint section under CR 59. Conditions resulted in the Track Hoe tipping over toward a ditch, and exposed employees to the hazard of being caught in-between the Track Hoe and the ground. Abatement note: The Power Crane and Shovel Association standard No. 3, Mobile Hydraulic Excavator Standards, Section 8.3.3.8, provides, "Ground and Support Conditions - Capacity ratings are based on the condition of a firm supporting surface under the machine."
