OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of falling which are causing or likely to cause death or serious physical harm to employees: a. On or about October 22, 2015, in the east side of the warehouse, employees were raised approximately 10 feet using an unsecured 8-foot by 4-foot wooden pallet placed lengthwise on the forks of a Clark Forklift, Model C25CL, S/N 023109099592, to store foam products on a elevated racks. b. On or about October 22, 2015, and times prior thereto, throughout the warehouse, a 16-foot PW Platform, Inc., Rolling Safety Ladder, S/N 63949, that had bent bracing, missing rubber pads, and broken casters, was used to store materials at heights up to approximately 10 feet.
