29 CFR 1926.25(a): During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:     a)  Back Yard - On or about 10/23/2015, construction laborers were exposed to puncture injuries from nails left in refuse lumber which had not been withdrawn and which was stored in and immediately next to a walkway.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:      a)            First Floor  On or about 10/23/2015, construction laborers cleaning up a construction project were exposed to tripping/fall hazards where a 22 inch by 24 inch floor hole was not provided with a cover.     b)            First Floor  On or about 10/23/2015, construction laborers cleaning up a construction project were exposed to tripping/fall hazards where a 16 inch by 29 inch floor hole was not provided with a cover.     c)            First Floor  On or about 10/23/2015, construction laborers cleaning up a construction project were exposed to tripping/fall hazards where a 24 inch by 51 inch floor hole was not provided with a cover.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.62(d)(1)(i): Each employer who has a workplace or operation covered by this standard shall initially determine if any employee may be exposed to lead at or above the action level:     a)  First Floor  The employer did not perform initial monitoring for the presence of actionable levels of lead where construction laborers were shoveling and bagging painted plaster for disposal without appropriate personal protective equipment.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
