29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user. a. On or about October 16, 2015, the employer did not provide medical evaluations to determine new employees' ability to use a respirator before allowing the employees to voluntarily use the tight-fitting facepiece respirators supplied to them. All provisions of 29CFR 1910.134(d) through (o) must be covered in a respiratory protection program. Key elements include, but are not limited to the following: 1. Selection of respirators and Hazard Evaluation 2. Medical Evaluation 3. Maintenance and Care of Respirators 4. Identification of Filters, Cartridges, and Canisters 5. Training and Information 6.
