29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    (a) Linton Masonry LLC on or about November 03, 2015, at the address of 5291 Detroit Rd. Sheffield Lake, OH: The employer failed to ensure a ladder or similar means of access was provided to employees using a welded frame scaffold. The employees were exposed to a fall to the ground below when utilizing the frame and crossbrace members of a masonry walkthrough scaffold to climb to the platform above.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail when the crossing point of two braces is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart.    a) Linton Masonry LLC on or about November 03, 2015, at the address of 5291 Detroit Rd. Sheffield Lake, OH:  The employer failed to ensure employees were protected from falls while working from a masonry walkthrough scaffold system. In addition to the rear crossbracing substituting for the top rail, the employer had not installed a midrail prior to permitting employees to operate atop the second frame platform. Employees performing masonry work in this condition were exposed to a 14 ft. fall to the ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  (a)  Linton Masonry LLC on or about November 03, 2015, at the address of 5291 Detroit Rd. Sheffield Lake, OH: The employer did not ensure employees working from a tubular welded frame scaffold were trained to recognized and avoid hazards associated with this type of scaffold, such as fall hazards relating to: guardrail systems and acceptable access/egress methods.
