29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about November 04, 2015, an employee at the construction site was exposed to struck-by hazards when not wearing a protective helmet, while the Owner was working above on the pump jack scaffold using pneumatic staple gun for installing the exterior Styrofoam insulation siding to the residential home.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: On or about November 04, 2015, employees were exposed to falls of approximately 14 feet in height to the ground level below, when working from a pump jack scaffold which did not have a guard rail system, while installing the Styrofoam insulation siding to the residential home.
