29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) Constitution Ave. and 17th. Streets, NE - On or about 11/02/2015, workers were known to the site competent person to be installing a water line in a 6 foot deep excavation, which was comprised of class C soil, and having vertical walls which was not completely or adequately shored. No abatement certification or documentation required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that, no inadequate wood shoring was provided: a) Constitution Ave. and 17th. Streets, NE - On or about 11/02/2015, utility workers installing a 12 inch water main in a 6 foot deep excavation where not provided with adequate protective systems appropriate for class C soil conditions. No abatement certification or documentation required for this item.
