OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On November 5, 2014, at 4733 Morse Road, Columbus, Ohio, an employee was working from a job made elevated scaffold platform. The platform was 16 feet wide and supported by a rough terrain forklift that was eight feet, four inches wide. The platform extended three feet, ten inches past the outside of each tire, exposing the employees to a 15 foot, six inch fall hazard.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On November 5, 2014, at 4733 Morse Road, Columbus, Ohio, fall protection was not used by an employee was working on the framing of the front entrance. The employee was standing on the roof, thereby being exposed to a 15 feet, 6 inch fall hazard. ACA Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 987358, citation number 1, item number 1, and was affirmed as a final order on August 25, 2014 with respect to a workplace located at 528 Beaver Street, Mars, PA 16046.
