OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls working on step ladder in partially closed position and standing on the top cap of ladder. (a) Location - Main Street, Waltham, MA: On or about 11/9/15, an employee was exposed to falls working on a step ladder that was in partially closed position and standing on the top cap of ladder. Among other methods, one feasible and acceptable means of abatement to correct this hazard is to train employees in requirements under Reference ANSI-ASC A-14.5-2007, Section 9.3 -Rules for Ladder Use, 9.3.1- Intended Use, 9.3.1.2- Self-supporting ladders shall not be used as single ladders or in the partially closed position. Section 9.3.2- Climbing and Working Locations. The user shall climb or work with the body near middle of the step or rung. The user shall not step or stand higher than the step or rung indicated on the label marking the highest standing level of a ladder. The user shall not step or stand: (1) a ladder top cap and the top step of a step or trestle ladder, or the bucket or pale shelf of a self-supporting ladder.
