29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury (a) North driveway of New Kroger Building - On or about November 4, 2015 employees installing steel beams used a forklift to placed a 64 foot beam partially on a asphalt driveway and unstable dirt at a 2 degree slope. The unsupported beam fell over onto the leg of an employee placing blocks a few feet east of the beam. The beam amputated the employee left leg below the knee.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck "AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)" . Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178 (a) Kroger Jobsite in Hernando, MS - On or about November 4, 2015 the employer had not provided or ensured that employees operating the all-terrain forklift had completed powered industrial truck training.
