29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) In the warehouse/production area, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 79.22% (88.3 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) during the 457 minute sampling period. Zero exposure was assumed for the 23 minute period not sampled. This violation was discovered on or about January 26, 2016.  b) In the warehouse/production area, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 70.23% (87.4 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 90 dBA) during the 459 minute sampling period. Zero exposure was assumed for the 21 minute period not sampled. This violation was discovered on or about January 26, 2016.

A Foundry Worker was exposed to lead at an 8-hour time weighted average (TWA) of 0.008106 milligrams per cubic meter (mg/m3) of air. Sampling was performed for 457 minutes.  Zero exposure was assumed for the 23 minute period not sampled. This violation was discovered on or about January 26, 2016.  b) In the warehouse/production area, an initial determination was not conducted for employees exposed to lead during activities such as, but not limited to, melting aluminum and pouring it into molds. A Foundry Worker was exposed to lead at an 8-hour time weighted average (TWA) of 0.00145 milligrams per cubic meter (mg/m3) of air. Sampling was performed for 456 minutes.
