D trench along the northern wall without adequate cave-in protection. The employer had constructed one 5 ft. H bench on the northern wall at an approximate 73 deg. angle and not the required 45 deg. angle required for Type B soil.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. a) On or about 11-12-15 at Oakridge and 17th Streets in Kaukauna, Wisconsin, the employer did not use a manual analysis of the soil for classification prior to employees working in an approximately 10 ft. D trench. A visual test only was used to configure a benching system of a 5 ft. H single bench with approximately 73 deg. wall angle not the maximum 4 ft. H bench and 45 deg. angle required for Type B soil.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) On or about 11-12-15 at Oakridge and 17th Streets in Kaukauna, Wisconsin, the employer did not conduct adequate safety inspections prior to employees working in an approximately 10 ft. D trench. Complete soil testing and classification was not conducted, 5 ft. H single bench used was not within the 4 ft. maximum allowed height for Type B soil, and no written design of the support system available for the trench shield. The Scott Lamers Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(1), which was contained in OSHA inspection number 902120, citation number 001, item number 003 and was affirmed as a final order on 08-07-13, with respect to a workplace located at 652 Main Street, Belgium, WI 53004.
