29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    a) On or about 11/10/2015, at jobsite at 69-07 69th Place, Glendale, NY 11385    The employer had not developed and implemented a noise monitoring program, even though employees operating and working in the vicinity of press machinery producing metal trays and plates, as well as plastic lids, were exposed to time weighted averages of 87-92.3 decibels, A-weighted scale (dBA), while working extended shifts of at least 9.5 hours, which resulted in adjusted action levels of 83.7-83.9 dBA depending on the exact length of the monitoring time. The adjusted action level is used instead of the 85 dBA level when shift length exceeds 8 hours, and means that any employee or job description with a time weighted average exposure above that action level must be included in a hearing conservation program.    WRITTEN ABATEMENT CERTIFICATION REQUIRED.
