29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: On or about 11/10/2015, ABG Builds had an employee in an aerial lift at 1950 First Capitol Drive, St. Charles, MO. The general contractor or controlling employer did not conduct an adequate inspection of the job site, materials, and equipment. The employee was not utilizing a personal fall arrest system while working from an elevated aerial lift. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos, which you believe will be helpful. The abatement certification sheets are enclosed with the citation(s).

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e): On or about 11/10/2015, an employee from ABG Builds was working at 1950 First Capitol Drive, St. Charles, MO. The employee was working/welding on the metal stud wall of a commercial building in an aerial lift. The employee was not wearing a personal fall arrest system attached to the boom or basket. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos, which you believe will be helpful. The abatement certification sheets are enclosed with the citation(s).
