29 CFR 1910.141(a)(4)(ii): Wastes were not removed as often as necessary to maintain the place of employment in a sanitary condition: (a) On or about November 13, 2015 on the second floor of the ATF facility, the floors, windows, and other spaces were found to be littered with dead flies. It is likely these were present due to rodents/ dead rodents that were in the walls and ceiling. The flies had been allowed to stay there. Employees were exposed to potential diseases from a fly infestation.

29 CFR 1910.141(a)(5): Enclosed workplace(s) were not so constructed, equipped, and maintained to prevent the entrance or harborage of rodents, insects, or other vermin. A continuing and effective extermination program was not maintained: (a) On or about November 13, 2015 on the second floor of the ATF facility, the floors, windows, and other spaces were found to contain an infestation of living and dead flies. It is likely these were present due to rodents/ dead rodents that were in the walls and ceiling. While rodenticide was in use, no insecticide was being used, and the source of the infestation had not been addressed. Employees were exposed to potential disease from a fly infestation.
