OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards and death:  a.  On or about November 12, 2015, at the backyard of the dock area of a private residence, two employees who used chain saws while cutting down palm trees, were exposed to amputation hazards and death.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  a. On or about November 12, 2015, at the backyard of the dock area of a private residence, one employee working on the ground using a chainsaw to cut palm trees was not wearing chaps, exposing himself to serious cuts or an amputation hazard.

29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:  a. On or about November 12, 2015, at the backyard of the dock area of a private residence, employees were cutting down palm trees at a private residence without the use of safety glasses were exposed to being hit in the eye by flying debris while using a Stihl MS201t and a Stihl MS 440 chain saw.

On or about November 12, 2015, employees cutting down palm trees at the backyard of the dock area of a private residence were exposed to overhead hazards, in that they were not required to wear a hard hat.
