OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards of up to 15 feet: a) On or about November 16, 2015 and times prior; roof of front storage buildings: The employer exposed employees to falls up to 9'10" when employees got onto and off an unsecured wood pallet lifted by a Nissan forklift without fall protection being used to conduct seam repair with rubber sealant. b) On or about November 16, 2015 and times prior; roof of back storage buildings: The employer exposed employees to falls of approximately 15' when employees got onto and off an unsecured wood pallet lifted by a Nissan forklift without fall protection being used to conduct seam repair with sealant.
