29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   At the jobsite located at 12630 Newton St.,  Building 20, Overland Park, KS 66062; employees engaged in stucco mixing were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to Akroflex Semi Smooth Finish Mason Mix.

29 CFR 1926.451(c)(3): Supported scaffold poles, legs, post, frames, and/or uprights were not plumb and braced to prevent swaying and displacement:  At the jobsite located at 12630 Newton St.,  Building 20, Overland Park KS 66062; employees engaged in stucco work from the scaffold were exposed to hazards associated with scaffold collapse, such as struck-by and fall hazards of up to approximately 13 feet from the working level to the ground in that the scaffold was not fully braced with cross braces.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  At the jobsite located at 12630 Newton St., Building 20, Overland Park, KS 66062; employees climbing the scaffold frame to access the working level of the scaffold to perform stucco work were exposed to fall hazards of up to approximately 13 feet from the scaffold to the ground in that a safe means of access to the working level platform was not provided.
