29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 ug/m3) calculated as an 8-hour time-weighted average (TWA): On or about 10/01/2015, at a worksite located at 212 Durkee St., Appleton, WI 54911, the exposing employer Corcoran Glass & Paint, Inc. had not initially determined if any employee could be exposed to lead at or above the action level when painter employees working in the south portion of the basement preformed abrasive blasting of pillars with coatings containing lead paint.

29 CFR 1926.62(d)(2)(v): Prior to the performance of an employee exposure assessment as required under paragraph (d) of this section, the employer did not provide to employees performing the tasks described in paragraphs (d)(2)(i) through (d)(2)(iv) of this section with interim protection, as indicated in paragraphs (d)(2)(v)(A) through (d)(2)(v)(F): On or about 10/01/2015, at a worksite located at 212 Durkee St., Appleton, WI 54911, the exposing employer Corcoran Glass & Paint Inc. did not provide painter employees who were conducting abrasive blasting of pillars with coatings containing lead paint with appropriate interim protections as required by this section such as, but not limited to, the following: 1) Respirators capable of protection from lead in excess of 2500 mg/m3 (50xPEL) 2) Coveralls or similar full-body work clothing 3) Clean change areas 4) Adequate hand washing facilities and hygiene practices 5) Medical surveillance 6) Employee training on lead hazards and requirements
