29 CFR 1910.95(d)(1)(ii): Unless the employer can show that area sampling produces equivalent exposure monitoring, the employer did not use representative personal sampling to comply with the monitoring requirements of 29 CFR 1910.95(d):  (a) On December 22, 2015, the employer failed to conduct representative personal noise sampling to comply with the monitoring requirements of 29 CFR 1910.95(d).   (1) A machine operator employee was exposed to continuous noise levels at 164.2% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 93.5 dBA. The sampling was performed for 422 minutes during one shift on December 22, 2015; exposure calculations included a zero increment for the 58 minutes not sampled.  (2) A machine operator employee was exposed to continuous noise levels at 131% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 91.9 dBA. The sampling was performed for 413 minutes during one shift on December 22, 2015; exposure calculations included a zero increment for the 67 minutes not sampled.  (3) A packer employee was exposed to continuous noise levels at 109.2% of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 90.6 dBA. The sampling was performed for 428 minutes during one shift on December 22, 2015; exposure calculations included a zero increment for the 52 minutes not sampled.  (4) A packer employee was exposed to continuous noise levels at 99.6 % of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 89.9 dBA. The sampling was performed for 414 minutes during one shift on December 22, 2015; exposure calculations included a zero increment for the 66 minutes not sampled. 29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet    (a) IN THE FACILITY: the employer failed to keep an accurate list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet. Employees were exposed to hazardous chemicals including but not limited to sodium hydroxide (caustic), sulfuric acid (corrosive), phosphoric acid (corrosive), hydrochloric acid (corrosive), methanol (toxic, flammable), formaldehyde(toxic, flammable), acetone (toxic, flammable), toluene (toxic, flammable), styrene(toxic), benzene (toxic, flammable), xylene (toxic, flammable), dicyclohexylmethane-4,4' diisocyanate(toxic), and trimethylbenzene(toxic, flammable).    Abatement certification is required for this item - use CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)    (a) On November 17, 2015, the employer failed to ensure that required safety data sheets were readily accessible during each work shift to employees, in that members of management onsite on this date could not promptly locate the binder containing safety data sheets. Employees were exposed to hazardous chemicals including but not limited to sodium hydroxide (caustic), sulfuric acid (corrosive), phosphoric acid (corrosive), hydrochloric acid (corrosive), methanol (toxic, flammable), formaldehyde(toxic, flammable), acetone (toxic, flammable), toluene (toxic, flammable), styrene(toxic), benzene (toxic, flammable), xylene (toxic, flammable), dicyclohexylmethane-4,4' diisocyanate(toxic), and trimethylbenzene(toxic, flammable).    Abatement certification is required for this item - use CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
