29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent): Elevated work modules: On, or about, November 17, 2015, employees were exposed to fall hazards due to the lack of guardrails provided along the industrial racking bays where product was delivered to the Replenishment sides of Modules 1 and 2. Employees worked along the unprotected rack bays throughout their shift, retrieving merchandise from pallets and totes.

29 CFR 1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed: Maintenance Area: On, or about, November 17, 2015, employees were provided with a Raymond Series 5008 self-retractable lanyard when working in the elevated work platform of the Genie Z-30/20N lift. The lanyard was designed to be used with an anchorage point located above the D-ring provided on the back of an employee's harness. The lanyard was mounted at the anchor point provided in the aerial lift basket that was level with the basket mid-rail.
