29 CFR 1910.178(q)(7): Industrial trucks were being placed in service after the examination showed a condition adversely affecting the safety of the vehicle: (a) On or about November 5, 2015, and at certain times before, powered industrial trucks were allowed to be placed in service after inspections revealed defects adversely affecting their safe operation. Specifically, the 8,000 pound (Tusk) powered industrial truck was allowed to be placed in service after an examination revealed that the unit did not have a working horn; and the 26,000 pound (Cat) powered industrial truck was allowed to be placed in service after an examination revealed that the unit did not have a working backup alarm. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
