OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by materials and equipment while installing a storm drainage system. On or about 18 November 2015, and at times prior thereto, four laborers were installing sections of a new storm drainage system while under a Volvo Excavator EC210CL bucket being used to move reinforced concrete pipe (RCP), exposing the employees to the hazard of being struck by materials and equipment.

29 CFR 1926.251(a)(2)(i): The employer failed to ensure rigging equipment had permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load. On or about 18 November 2015, and at times prior thereto, employees were using a wire rope sling to lift and move pieces of reinforced concrete pipe (RCP) with a Volvo Excavator EC210CL without the rated capacity for the sling attached, exposing the employees to the hazard of being struck by either falling materials or a whiplash effect from the sling.

On or about 18 November 2015, and at times prior thereto, an operator used a Volvo Excavator EC210CL with a bucket attachment to pull a wire rope sling out from under a piece of reinforced concrete pipe (RCP) while attached to the bucket eye bolt, exposing the employees to the hazard of being struck from a whiplash effect by the wire rope sling.
