29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    (a) On November 24, 2015 located at 3211 Gardner Ave., Kansas City, MO 64120 employees were exposed to noise hazards when the employer failed to implement a monitoring program. The action level calculated based on an 8 hour time weighted average resulting in above 85 dBA. The employer failed to provide a safe and healthy work environment free of hazards associated with noise levels.    (1) An employee working in the warehouse was exposed to continuous noise levels at 63.4% dose of the allowable 8-hour time weighted average sound level of 85 dBA or equivalent sound level of approximately 86.7 dBA. The sampling was performed for 474 during one shift on November 24, 2015; exposure calculations included a zero increment for the six minutes not sampled.     (2) An employee working in the plant was exposed to continuous noise levels at 461.8% dose of the allowable 8-hour time weighted average sound level of 85 dBA or equivalent sound level of approximately 101 dBA. The sampling was performed for 474 during one shift on November 24, 2015; exposure calculations included a zero increment for the six minutes not sampled.     (3) An employee working in the plant was exposed to continuous noise levels at 357.1% dose of the allowable 8-hour time weighted average sound level of 85 dBA or equivalent sound level of approximately 99.1 dBA. The sampling was performed for 474 during one shift on November 24, 2015; exposure calculations included a zero increment for the five minutes not sampled.
