29 CRF 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference: For work on the shoulder of Ord Street, the traffic control devices used for protection of construction workers did not follow the Manual on Uniform Traffic Control Devices as there was only one traffic cone, channelizing device, used near the northwest corner of Ord Street. Employees installing form work for a concrete V-ditch were exposed to the hazard of being struck by vehicles.

29 CFR 1926.600(a)(3)(i): All controls were not in a neutral position, with the motors stopped and brakes set, unless work being performed requires otherwise. Bulldozer and scraper blades, end-loader buckets, dump bodies, and similar equipment, were not either fully lowered or blocked when being repaired or when not in use: On property north of Ord Street, the motor was not stopped and the rear bucket was not fully lowered or the travel lock for the bucket was not secured on a CAT backhoe, model number 420E, serial number G4D07277, when the operator got off of the backhoe and left the site with the foreman in a pickup truck. Employees were exposed to the hazard of being struck by the backhoe.
