OSH ACT of 1970 Section (5)(a)(1): : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to potential burns due to fire and explosion hazards:       A.)  Insert Molding Technologies, Inc.; Dust Collector Room; - On or about 11/19/15, and at times prior thereto, employees were potentially exposed to fire and explosion hazards from a dust collector located inside.  Dust collectors included, but were not limited to, the Torit dust collector which was located inside the building and was not equipped with any devices to mitigate a potential dust explosion.  The dust collector collected explosive plastic dust.    B.)  Insert Molding Technologies, Inc.: Dust Collector Room - On or about 11/19/15, and at times prior thereto, employees were potentially exposed to fire and explosion hazards from a dust collector that was not equipped with approved devices to prevent and/or mitigate the propagation of a dust explosion and/or associated flame fronts.  Dust collectors included, but were not limited to, the Torit dust collector which was not equipped with devices to prevent the propagation of a dust explosion and associated flame fronts throughout the dust collection system and associated duct work.  The dust collector collected explosive plastic dust.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval.  Capacity, operation, and maintenance instruction plates, tags or decals of the powered industrial truck were not changed accordingly:      A.)  Insert Molding Technologies Inc. - On or about 11/19/15, and at times prior thereto, forklift attachments were utilized on forklifts that included but were not limited to, Clark forklifts.  The forklift attachments included, but were not limited to, Apex dumping hoppers.  The forklift manufacturer's approval was not obtained to use the hopper on the Clark forklift.  In addition, the capacity, data, and limitation plates of the forklift had not been changed.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:   A.)  Insert Molding Technologies Inc. - On or about 11/19/15, and at times prior thereto, forklift attachments were utilized on forklifts that included but were not limited to, Clark forklifts.  The Clark forklift was not marked and/or equipped with a plate to identify the hopper, hopper/truck weight combinations, and the dump hoppers affect on the trucks load capacity.
