29 CFR 1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.  Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.  The specific machine energy control procedure for Line 15, MA-15, KTI, turret machine was not utilized when an employee reached with their right hand underneath a plastic film to check the cut of the film from the slitter knives.

29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a.  A Press Operator performing a set up of Line 15, MA-15 KTI Press Line was not trained as an authorized employee to recognize the type and magnitude of the energy and the methods and means necessary for energy isolation and control.   b.  A Turret Operator inspecting the plastic film on Line 15, MA-15, KTI, for the proper slitter knife cut was not trained as an authorized employee to recognize the type and magnitude of the energy and the methods and means necessary for energy isolation and control.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:   Employees who performed servicing and maintenance on Line 15, MA-15 Press Line were not required to:  (1) know the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy. (2) turn off and shut down the machine (3) physically located and operate energy isolating devices in such a manner as to isolate the Press Line from the energy source. (4) affix lockout devices to each energy isolating device (5) prior to starting work on the Press Line that have been locked out, verify that isolation and deenergization of the machine have been accomplished.    Employees were performing a set up of Line #15, MA-15 Press Line and were exposed to caught in-between hazards from the unexpected start up and energizing of the Press Line.

29 CFR 1910.147(f)(1)(ii): Remove employees from the machine or equipment area in accordance with paragraph (e)(2) of this section;  On or about November 20, 2015, on Line 15, while the set up of the press was almost complete, a Turret Operator's right hand and arm was exposed to a in-running nip point between the film and spindle while checking the cut on the film from the slitter knives and was not removed from the danger zone area of the machine.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  The employer did not notify OSHA within 24 hours after the incident involving an in-patient hospitalization occurring on November 12, 2015 at approximately 8:00am until November 13, 2015 at 5:00pm through the OSHA hotline.
