29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied. (a) At the Porch Area: Employee utilized a Sky Trak rough terrain forklift, model # 8042, serial # 0160020012 to support a temporary elevated platform. An employee worked from the temporary elevated platform, which measured 8 feet 1 inch X 4 feet 7 1/2 inches X 3 feet 8 inches to install wood covers. The temporary elevated platform was not positively attached to the forks of the Sky Trak. An employee fell approximately 12 feet from the temporary elevated scaffold. The temporary elevated platform subsequently fell off the forks onto the fallen employee. The employee suffered fatal injuries as a result of this incident.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) At the Porch Area: An employee utilized a temporary elevated platform to install wood boxes to cover a beams on a porch. The employee was not equipped with a personal fall arrest system. The temporary elevated platform was not equipped with guardrails. The employee was exposed to a fall hazard of approximately 12 feet.
