29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a)  Insituform Technologies, Inc. at 23rd Ave. and 2nd Street, Greeley, CO 80631:  On or before November 4, 2015, the controlling and exposing employer did not instruct each employee in the recognition and avoidance of unsafe conditions specific to this work environment, and the actions necessary to eliminate, control, and mitigate the associated hazards.  The unsafe conditions included:     1)  The volume of traffic;    2)  The temporary lane closures of one lane of a two lane road using flaggers;     3)  The movement of personnel, equipment, materials, and supplies in the work zone;    4)  The duration of work including working at night; and    5)  The fall hazards associated with open manholes.    Conditions exposed employees to the hazard of being struck-by motor vehicles, and fall hazards.    Abatement note:  The instruction failed to include the movement of the employees, equipment, and materials in the work zone; the duration of work; the traffic control plan; and the communication with and between flaggers.

29 CFR 1926.56(a): While work was in progress, construction areas, ramps, runways, corridors, offices, shops or storage areas were not lighted to the minimum illumination intensities as listed in Table D-3 of 29 CFR 1926.56:    a)  Insituform Technologies, Inc. at 23rd Ave. and 2nd Street, Greeley, CO 80631:  On or before November 4, 2015, while work was in progress, the construction area was not lighted to the minimum illumination intensities as listed in Table D-3 of 29 CFR 1926.56.  Flaggers were directing traffic at flagger stations set up at the northbound and the southbound lanes of 23rd Avenue, and at the westbound lane of 2nd Street.  The sewer bypass company was connecting pipes and a pump to the existing sewer line that was accessed through the manhole located at this intersection.  The controlling employer did not provide adequate lighting for the flagger stations, nor at the manhole where the sewer bypass pump crew was working.  The sunset was at 4:52 pm, and at 6:39 pm, a flagger was struck by a vehicle travelling in a 35 mph speed zone.  The work area was not provided with at least 5 foot candles of illumination.  Condition exposed employees to the hazard of being struck by motor vehicles, and to fall hazards, resulting in serious bodily injury.

29 CFR 1926.1203(e)(2)(ii): (ii) When entrance covers were removed, the opening was not immediately guarded by a railing, temporary cover, or other temporary barrier to prevent an accidental fall through the opening and that would protect each employee working in the space from foreign objects entering the space:     a)  Insituform Technologies, Inc. at 23rd Ave. and 2nd Street, Greeley, CO 80631:  On or before November 10, when manhole covers were removed, the manhole openings were not immediately guarded by a railing, temporary cover, or other temporary barrier to prevent an accidental fall through the opening.  The exposing and controlling employer did not ensure that employees and sewer bypass company employees were protected from fall hazards when the manholes covers were open.  The employer was lining the existing sewer line, and the sewer bypass company was connecting the sewer bypass piping and a pump to the existing sewer line.  Condition exposed employees to fall hazards of up to 10 feet, and to confined space hazards, during this work.
