29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:   a)   At the asphalt manufacturing facility: On November 11, 2015, and at times prior thereto, the employer exposed employees to fall hazards of up to approximately 70 ft., in that broken guardrails existed while employees performed various maintenance activities on the top platform of the 100-ton main silo.    b)   At the asphalt manufacturing facility: On November 11, 2015, and at times prior thereto, the employer exposed employees to fall hazards of approximately 10.5 ft., in that missing guardrails existed atop a fabricated ladder-and-platform assembly while employees accessed the platform to periodically measure liquid-asphalt levels of a tank.

The foregoing provisions do not apply when liquefied petroleum gas containers of 125 gallons or less capacity are installed adjacent to fuel oil supply tanks of 550 gallons or less capacity:  a)   At the asphalt manufacturing facility: On November 11, 2015, and at times prior thereto, the employer exposed employees to fire and burn hazards, in that a diked 2,000 gallon above-ground diesel storage tank and a 250-gallon LPG tank were separated by approximately 5 ft. as employees used each for motor fuel and asphalt heating.
