OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazard of struck-by:    On or about 11/23/2015, employee(s) working at Quest Graphics located at 2423 Northline Industrial Drive, Maryland Heights, MO, were exposed to an amputation hazard.  The employer had various forklift operators operating their lifts without seat belt protection.  One such forklift was a 25 Komatsu, Model: FG25ST-11, S/N: 407179A.  The Letter of Interpretation dated March 7, 1996 addresses this condition and references ASME B56.1-1993.    One method of abatement is for the employer to ensure that employees do wear their seat belts while operating the Power Industrial Trucks (forklifts) and that the employer follows ASME B56.1-1993. 29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.:     On or about 11/23/2014, employees from Quest Graphics located at 2423 Northline Industrial Drive, Maryland Heights, MO, were exposed hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  The following machines did not have guards:    The Victor Lathe (Model: 2080, S/N: 710671) in Building #1s Maintenance Area was missing chuck guards.    The Wilton horizontal band saw (Model: 3535, S/N: 090037) had nonworking portions of its blade not adequately guarded in Building #1s Maintenance Area.  Approximately seven and three quarters of an inch to the left of the left side material vice, and approximately two inches to the right of the right side material vice.    The Cousins Shrink Wrapper (Model: HP2100, S/N: 250507-2H-7086) in Building #2s Shipping Department was a mechanically operated wrapper which employee(s) were exposed to the rotating hazard.  Other employee(s) working in the area were exposed.    The Quest Graphics was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 952103, citation number 1, item number 2a and was affirmed as a final order on 10/28/2015, with respect to a workplace located at 2423 Northline Industrial Drive, Maryland Heights, MO.

29 CFR 1904.29(a): Basic requirement. You must use OSHA 300, 300-A, and 301 forms, or equivalent forms, for recordable injuries and illnesses. The OSHA 300 form is called the Log of Work-Related Injuries and Illnesses, the 300-A is the Summary of Work-Related Injuries and Illnesses, and the OSHA 301 form is called the Injury and Illness Incident Report:   On or about 11/23/2015, during an Amputation NEP inspection at Quest Graphics located at 2423 Northline Industrial Drive, Maryland Heights, MO, the Comptroller stated that the company has not kept up with its OSHA 300 forms.  Quest Graphics employees approximately 53 employees.
