29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. A.) Mark Wengerd dba MNW Construction, 205 W 10th Street, Erie, PA 16501, roof of the Knights Inn, on or about November 17, 2015 and times prior thereto: Employees were performing roofing operations including, but not limited to, applying a spray foam roofing material to the roof of the structure. Employees were exposed to a fall hazard of 19-feet. The employees were not utilizing a means or method of fall protection including, but not limited to, guardrail systems, safety net systems, personal fall arrest systems, or safety monitoring system.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. A.) Mark Wengerd dba MNW Construction, 205 W 10th Street, Erie, PA 16501, roof of the Knights Inn, on or about November 17, 2015 and times prior thereto: Employees were utilizing a metal extension ladder to access the roof of the structure. The metal extension ladder was 1.5-feet above the level of the parapet wall. The ladder was not otherwise secured from displacement or equipped with a grasp device.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided: A.) Mark Wengerd dba MNW Construction, 205 W 10th Street, Erie, PA 16501, roof of the Knights Inn, on or about November 17, 2015 and times prior thereto: Employees were utilizing a metal extension ladder to access the roof of the structure. The metal extension ladder was 1.5-feet above the level of the parapet wall. To mount / dismount the ladder, the employee must step upon the parapet wall. The break in elevation from the top of the parapet wall to the roof surface was 25.2-inches. Devices such as stairways and ladders were not provided for employees to travel between the top of the parapet and the roof.
