29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: a) Rutter's Roof - An employee installing shingles was exposed to eye injuries from not wearing protective equipment over his eyes while using a roofing air nailer, on or about November 18th, 2015. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail system with toe boards, safety net system, or personal fall arrest systems: a) Rutter's Roof - Employees roofing a 5 x 12 pitch roof were exposed to falls greater than nine (9) feet without the use of a guardrail system, safety net system, or personal fall arrest systems, on or about November 18th, 2013. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. M & T Roof Restoration, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 962772, citation number 1, item number 1 and was affirmed as a final order on March 27, 2014, with respect to a workplace located at 514 East Beaver Street State College, Pennsylvania.
