OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing injuries associated with the tipping over of a steel racking system which were not anchored to the floor with anchor bolts capable of resisting the forces caused by the horizontal and vertical loads on the rack: Employees engaged in material handling activities in the following locations were exposed to struck-by hazards in that the steel racking was not anchored to the floor to resist forces caused by the horizontal and vertical loads and potentially being struck by moving equipment. a) The Braiding area b) The Shipping/Receiving area Among other means, one feasible and acceptable method to abate this hazard is to follow ANSI MH 16.1: 2012 ANSI-RMI - Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks 1.4.7 Column Base Plates and Anchors - The bottom of all columns shall be furnished with column base plates, as specified in the Section 7.1. All rack columns shall be anchored to the floor with anchor bolts, which shall be designed in accordance with Section 7.3, to resist all applicable forces as described in Section 2.1 or Section 2.2 or to follow the manufacturers for anchoring column base plates to resist the forces caused by the horizontal and vertical loads on the rack(s).

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: Employees engaged in machining activities at the Braiding area for the following Wardwell Braiding machines were exposed to struck-by and amputation hazards in that machine guarding for point of operations was not provided and utilized: a) Machine #1, 2, 8, and 10, not fully guarded, exposed one of the sides and the back side. b) Machine #3, 4, 5, not fully guarded, exposed one of the sides. c) Machine #6, fully guarded all around, but too short, there was no flexi-glass guard on the top to guard the point of operation; employee hands or fingers can be reached inside. The Vermillion Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(1), which was contained in OSHA inspection number 909231, citation number 1, item number 2 and was affirmed as a final order on 7/8/2013, with respect to a workplace located at 4754 South Palisade Wichita, KS 67217.
