OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  the employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by, flying shrapnel, hazards.  a) On or about November 9, 2015 the employer failed to furnish employment and a place of employment which was free from recognized hazards in that schedule 40 poly (vinyl chloride) PVC pipe was used as a pressurized vessel to transport compressed air and butyl cellosolve above ground as a purge system for fusion purge guns located in the coating building. Improper materials of construction cause the pipe to explode under pressure, resulting in struck-by and other hazards to the operator of the equipment   Among other methods, one feasible means to abate this hazard is to replace the PVC pressurized purge system with materials suitable for the maximum air pressures as recommended by the Plastic Pipe Institute, such as ABS or metal, or to follow recommendations outlined in American National Standards Institute/American Society of Mechanical Engineers.  American National Standards Institute/American Society of Mechanical Engineers (ANSI/ASME) B31.1 2007 Power Piping 105.3 Nonmetallic Pipe-(A) Plastic pipe may be used for water and nonflammable liquids where experience or tests have demonstrated that the plastic pipe is suitable for the service conditions, and the pressure and temperature conditions are within the manufacturers recommendations.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    a) Sabre-FWT Hicksville, Ohio; On or about November 9, 2015 the employer failed to provide medical evaluations for employees required to wear Chemax2 Loose Fitting Air Supplied Hoods during core coat applications in the coating building to determine if the employee was fit to wear the respirator.
