29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about November 24, 2015, while using a flat roof as a walking/working surface to install siding material on the side of a building during the construction of a brewery, the employer did not ensure employees were protected from a fall of approximately 18 feet, by utilizing a guardrail system, safety net system and/or personal fall arrest system.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: On or about November 24, 2015, during the construction of a brewery the employer did not ensure a step or self-supporting ladder was used in the manner and purpose for which it was designed. An employee used a self-supporting or step ladder was a single ladder by not extending the rear section all the way open and locking the spreader devices.
